American Judge Overturns Trump's Order on Asylum Ban

A federal judge in the United States has barred the Trump administration from enforcing its decision to reject asylum requests from migrants who have illegally entered the country through the southern border. On November 9, President Donald Trump issued an order stating that individuals requesting asylum at checkpoints along the southern U.S. border are not eligible for asylum. As a caravan of Latin American migrants approaches the Mexico-U.S. border, Trump has emphasized that the asylum ban is necessary for national security, claiming these migrants pose a threat to U.S. national security. However, Judge Jon Tiger agreed that human rights groups could sue the U.S. government, as U.S. immigration law clearly allows anyone to request asylum, even if the request is made at border checkpoints. Judge Tiger also stated that the government has abused its authority to set emergency regulations and to waive the thirty-day period required for implementing policy changes under the law. He remarked, 'No matter how broad the President's powers may be, he likely cannot rewrite immigration law to create conditions that Congress has previously prohibited.' The Department of Homeland Security has not yet responded to the court ruling, which will be in effect for one month unless the government appeals. Estimates from the department indicate that approximately seventy thousand people request asylum at U.S. entry points each year. If the Trump administration ultimately wins this dispute, conditions will become much more difficult for thousands of asylum seekers trying to avoid being returned to their home countries.
