International Criminal Court Issues Arrest Warrants for Israeli and Hamas Leaders

On Thursday, December 1, judges of the International Criminal Court issued arrest warrants for Benjamin Netanyahu, the Prime Minister of Israel, Yoav Galant, the former Minister of Defense of Israel, and Ibrahim al-Masri, a leader of the terrorist group Hamas, on charges of committing "war crimes" and "crimes against humanity." Karim Khan, the prosecutor of the International Criminal Court, stated on May 21 of this year that he was seeking arrest warrants related to the attack on October 7, 2023, against Israel and Israel's military response in Gaza. The International Criminal Court has announced that Israel's acceptance of its jurisdiction is not mandatory. Both Netanyahu and Galant could be arrested if they travel to any of the 120 member countries of the court. Israel rejects the jurisdiction of the International Criminal Court and the allegations of war crimes in Gaza. Meanwhile, Israel announced that it has killed Khalid al-Masri, also known as Mohammed Deif, in its attacks against Hamas. Hamas has neither confirmed nor denied the death of Mohammed Deif. Reactions: Senator Lindsey Graham, a Republican member of the U.S. Senate, reacted on Thursday, December 1, to the issuance of arrest warrants for Benjamin Netanyahu and Yoav Galant by the International Criminal Court, accusing the international body of corruption and stating that the court acted in the "most absurd and irresponsible manner possible" by issuing these arrest warrants. He noted on social media platform "X" that there are serious ambiguities regarding Karim Khan, the prosecutor of the International Criminal Court, adding that this court is a "dangerous joke." Senator Graham emphasized that it is time for the U.S. Senate to take action and sanction this irresponsible body through bipartisan legislation. He also called for this law to be signed by President Joe Biden. This Republican senator pointed out that the International Criminal Court has challenged any understanding and concept of fairness and legitimized the actions of a "corrupt prosecutor." John Fetterman, a Democratic senator from Pennsylvania, also strongly protested the ruling, describing the International Criminal Court as "lacking jurisdiction, irrelevant, and unenforceable." The office of Benjamin Netanyahu, the Prime Minister of Israel, issued a statement calling the arrest warrant from the International Criminal Court for him and Yoav Galant "anti-Semitic." Netanyahu's office described the court as a "biased political entity" and the allegations as "false and absurd." The office of the Prime Minister of Israel reminded the atrocities committed during the terrorist attack by Hamas on October 7 as the largest massacre of Jews since the Holocaust, asserting that there is no war more just than Israel's war in Gaza. This statement, referencing the sexual harassment allegations against Karim Khan, the prosecutor of the court, accused him and other judges of having "anti-Semitic hatred against Israel" and stated that no "anti-Israeli" ruling would prevent the country from defending its citizens. The office of the Prime Minister of Israel concluded the statement by emphasizing that Netanyahu will not succumb to any pressure and will continue his efforts to achieve all military objectives against Hamas and the terrorist axis of the Islamic Republic of Iran. Isaac Herzog, the President of Israel, also reacted to the ruling of the International Criminal Court, calling it "the choice of terrorism and the devil over democracy and freedom," which "turned the international judicial system into a human shield for Hamas's crimes against humanity." Naftali Bennett, the former Prime Minister of Israel, described the issuance of arrest warrants for Netanyahu and Galant by the International Criminal Court as a "stain of disgrace" for this international judicial body. Israel Katz, the Minister of Defense of Israel, also strongly criticized the ruling of the International Criminal Court in The Hague for issuing arrest warrants against Netanyahu and Galant, calling it "a moral disgrace that is completely tainted by anti-Semitism and reduces the international judicial system to its lowest degree." He also stated that this "shameful decision" serves the "head of the snake, namely the Iranian government and its proxies." Gideon Sa'ar, the Minister of Foreign Affairs of Israel, described the court's ruling as an attack on Israel's right to self-defense and a gift to the "axis of evil." Benny Gantz, the former Minister of Defense of Israel and an opponent of Netanyahu, called the ruling of the International Criminal Court "moral blindness and a historical stain" that "will never be forgotten." Yair Lapid, the former Prime Minister of Israel and an opponent of Netanyahu, also condemned the ruling of the International Criminal Court, reminding that Israel fights to defend itself against terrorist organizations that attack Israeli citizens, committing murder and sexual assault against them, and that the issuance of arrest warrants against Israeli leaders is a "reward for terrorism." According to Reuters, Josep Borrell, the European Union's foreign policy chief, stated that the ruling of the International Criminal Court is "not political, it must be respected and these warrants must be executed." Also, Kasper Wildkamp, the Dutch Foreign Minister, stated in remarks quoted by the ANP news agency that the Netherlands is prepared to execute the arrest warrant for Netanyahu if necessary. A spokesperson for the French Foreign Ministry also stated that France's response to this ruling will be "based on the laws of the International Criminal Court." Ayman Safadi, the Foreign Minister of Jordan, also stated that the court's rulings must be respected and executed, adding: "The Palestinians deserve justice." Hamas, the terrorist group supported by the Islamic Republic of Iran, in an official statement called for the International Criminal Court to expand its actions to what it termed "all criminal occupying leaders." Meanwhile, Francesca Albanese, the UN Special Rapporteur on Human Rights in the Palestinian Territories, wrote on social media platform "X": As the international community prepares for the potential consequences of this ruling, we must work together to "keep the flame of accountability alive." She expressed hope that "in this dark time, the voice of justice will grow stronger." During the terrorist attack on October 7 last year by Hamas against Israel, more than 1,200 residents, mostly civilians, were killed, and over 250 others, including women, children, and the elderly, were taken hostage. In response to this attack, Israel launched an offensive against Gaza aimed at destroying Hamas and recovering the kidnapped hostages. Reports indicate that the Gaza war, which was initiated by the terrorist attack by Hamas on Israeli citizens, has so far resulted in the deaths of tens of thousands and the displacement of residents in the area. While about 100 hostages were exchanged during a temporary ceasefire late last autumn for Palestinian prisoners, about 100 others remain in captivity with Hamas, and reports indicate that some of them have been killed.
