Judge Closes Trump's Case on 'Retention of Classified Documents'

Aileen Cannon, the district court judge appointed during Trump's presidency, stated in her ruling issued on Monday, July 16, that Jack Smith, the special prosecutor in this case from the U.S. Department of Justice, was illegally appointed to this position and therefore lacks the authority to form and lead this case. This ruling represents another significant victory for Donald Trump, the Republican candidate in this year's presidential election. His lawyers had requested the federal court last March to dismiss the case based on his 'immunity.' Trump sought the closure of his indictment related to the retention of classified documents. The U.S. Supreme Court also issued a historic ruling on July 2, stating that the former president enjoys immunity for many of his decisions and actions in the months following his defeat in the 2020 election. Trump is expected to be officially nominated as the Republican candidate for the presidential election in the coming days. The prosecution is likely to appeal the ruling issued by the Florida judge. Other courts in the U.S. have affirmed Jack Smith's authority in other cases brought by the Department of Justice against Donald Trump, which involve sensitive political issues. A spokesperson for Jack Smith's office declined to comment on Monday's ruling. The issuance of this ruling will at least leave the future of this case in ambiguity. Another indictment that Jack Smith has brought against Trump concerns the former president's role in questioning the results of the 2022 presidential election, in which Trump's lawyers did not challenge the special prosecutor's authority. In the case regarding government documents, Trump is accused of deliberately transferring classified documents to his personal residence after his presidency and obstructing the responsible authorities' efforts to retrieve these documents. Trump's lawyers questioned the legal authority of Merrick Garland, the U.S. Attorney General, to appoint Jack Smith as the special prosecutor for this case. They argue that the establishment of this special prosecutor's office was not approved by Congress and that the Senate did not confirm Jack Smith's authority to lead this case, thus rendering all these decisions unconstitutional. In contrast, the Justice Department lawyers argued that appointing a special prosecutor to pursue sensitive political cases is an established method within the Department of Justice. The ruling issued by Judge Aileen Cannon on Monday is another of her controversial rulings in favor of Donald Trump, expressing doubt about the prosecution's actions. This judge has previously postponed proceedings related to another case against Trump without setting a date for an uncertain future. In the recent proceedings, she allowed three lawyers unrelated to the case, two of whom were Trump's defenders, to present their arguments regarding Jack Smith's authority or lack thereof as a special prosecutor. Merrick Garland, the Attorney General and U.S. Secretary of Justice, appointed Jack Smith, the chief prosecutor for war crimes and government corruption, as a special prosecutor for this case in 2022 with the aim of pursuing the charges against Donald Trump independently of the government.
