Re-examination of Mohammad Qabadi's Case Following the Overturning of Death Sentence

Amir Reysian, the lawyer for Mohammad Qabadi, announced the overturning of his client's death sentence. According to the lawyer, the 'qisas' (retribution) sentence for Mohammad Qabadi, a prisoner protester condemned to death, has been overturned by the Supreme Court, and his case will be re-examined in a parallel branch. Previously, the court had accused Mohammad Qabadi of 'corruption on earth' and stated that he caused the death of 'Officer Vahid Kermpour Hasanvand' and injured five police officers through extensive actions against motorized police officers with a white Paykan car. The initial ruling had issued a 'qisas' sentence for this accused, which has now been overturned and referred back for re-examination. On Friday, June 16, Amnesty International sent an open letter to Gholamhossein Mohseni Ejei, the head of the judiciary of the Islamic Republic, calling for the immediate cancellation of two death sentences issued for Mohammad Qabadi. According to the letter, Amnesty International had obtained information indicating that 'Mr. Qabadi's right to a fair trial has been grossly violated.' 'Lack of access to a lawyer during the preliminary investigations, severe torture, preventing him from accessing medications related to his bipolar disorder, and forcing him to confess to killing several security officials were among the violations of Mr. Qabadi's rights during the trial,' which Amnesty International referenced in its letter. Amnesty International requested that Mohseni Ejei not only immediately cancel Mohammad Qabadi's death sentence but also ensure immediate and appropriate mental health treatment and regular access to his lawyer and family. Masoumeh Ahmadi, Mohammad Qabadi's mother, also published a note on Instagram asking the family of Farid Kermpour, the special forces officer killed during the nationwide protests for which Mohammad Qabadi was sentenced to 'qisas' for murder, to 'show mercy in honor of the martyr and, with their boundless compassion and forgiveness, grant a new life to my child.' Mohammad Qabadi, 22 years old, is one of the arrested protesters who has also been accused of 'moharebeh' (waging war against God) and 'corruption on earth.' The judicial authority attributed these accusations to claims of 'killing an officer' and 'injuring five other officers' by 'running them over with a car.'
