Report on FBI's Investigation into Possible Financial Crime Related to Leak of Classified Information

The Politico website recently reported that investigators from the Federal Bureau of Investigation (FBI) are examining whether Robert Malley, the former U.S. special envoy for Iran, committed a crime regarding the leak of classified information that was available to him. This accusation was made by Senator Jim Risch, a senior member of the Senate Foreign Relations Committee, and Michael McCaul, the chairman of the House Foreign Affairs Committee. They claimed that "Mr. Malley's security clearance has been suspended because he transferred classified documents to his personal email and downloaded these documents onto his personal phone." These two Republican representatives made this claim in a letter to Secretary of State Antony Blinken on May 6. The American newspaper "Washington Post" published this letter on May 7, and Reuters also released a report on the matter. Politico also reported on May 11, citing an individual familiar with the case who had seen the letter from the two Republican representatives, stating that investigators are trying to determine whether a crime was committed by Malley in this regard. According to this report, it is unclear whether the Department of Justice will bring charges against Mr. Malley and what the scope of any potential charges might be. Politico's report attempted to speak anonymously with individuals due to the high sensitivity of the matter. The website noted that based on information obtained through the letter and conversations with individuals, additional details are being added to the information regarding Robert Malley's case, including that "criminal investigations are underway in this regard." Although Robert Malley has refrained from commenting on the mentioned allegations, he has denied any wrongdoing. The FBI also declined to comment on the matter, stating that it "cannot confirm or deny the existence of specific investigations." The Department of Justice has not responded to Politico's request for comment. Robert Malley was appointed as the U.S. special envoy for Iran in 2021 after the Biden administration took office, tasked with reviving the Iran nuclear deal known as the Joint Comprehensive Plan of Action (JCPOA), which was abandoned during Donald Trump's administration. However, about a year ago, Mr. Malley's security clearance was suspended, and he went on full leave, with Abraham Paley taking over the duties of the Biden administration's special envoy for Iran. Previously, some news sites reported on what they described as the connections of individuals close to Robert Malley with the "Iran Expert Initiative Network," which they claimed is a network linked to the Islamic Republic. Robert Malley is currently on unpaid leave, and Abraham Paley continues to handle the duties of the Biden administration's special envoy for Iran. A spokesperson for the U.S. State Department also responded to Politico's questions, stating that Robert Malley remains on "leave" and that the agency does not comment on "long-standing procedures regarding individual security clearances." This spokesperson, who spoke anonymously to discuss internal personnel matters, stated that the department has provided Congress with information related to personnel investigations regarding Iran policy. Jim Risch and Michael McCaul did not provide details on how they became aware of the allegations they made against Malley, only claiming that they obtained the information through "their own investigations." Classified information systems at the State Department, where Robert Malley was stationed, are kept separate from ordinary systems, and the letter from the two Republican representatives did not mention the method of potential transfer of classified information by Mr. Malley. According to Politico's report, individuals familiar with the case have also stated that FBI investigators are examining whether Mr. Malley intentionally provided classified information to "foreign officials." It is unclear whether the term "foreign officials" refers to Iranian officials; however, given that classified documents related to Robert Malley were published in Tehran Times, an English-language publication aligned with the policies of the Islamic Republic, there is a possibility that the Islamic Republic targeted Robert Malley with its cyber attacks. According to this report, answering the question of whether Robert Malley intentionally or inadvertently transferred classified information to his personal email could influence the Department of Justice's decision against him.
