Senators Urge Biden Administration to Reassess Sanction Exemptions for the Islamic Republic

Ted Cruz from Texas and Tim Scott from South Carolina, along with several other members of the Senate Foreign Relations Committee, on Tuesday, December 5, sent a letter to Secretary of State Blinken, Treasury Secretary Yellen, and Defense Secretary Austin, calling for a reassessment of the sanction exemption policy for the Islamic Republic. The senators wrote in their letter: "If we want to stop attacks against American forces and prevent the escalation of war in Gaza, we need a deterrent signal using military, economic, and diplomatic tools. Unfortunately, the military and economic responses of the government to the Islamic Republic and its proxy forces have not only been inappropriate and disproportionate but seem completely disjointed." These American officials further stated in the letter: "We ask that you provide us with a classified assessment of the government's plan to prevent Iranian aggressions and to avoid escalation in the Middle East. This assessment should show how the Islamic Republic, which has created insecurity for U.S. individuals and interests, can utilize tens of billions of dollars in assets that are currently accessible due to your administration's policies and U.S. sanction exemptions." The senators also criticized the release of $6 billion in blocked Iranian assets in exchange for the return of detained Americans, adding: "This decision reinforced the extraordinarily dangerous precedent of paying ransom to the world's largest state sponsor of terrorism, and hearing that the administration is working hard to grant the Islamic Republic access to billions of dollars more is concerning." On November 13, 2023, the U.S. Department of State extended Iran's sanction exemption under the National Defense Authorization Act of 2012. Under this exemption, the Iraqi government is allowed to pay for electricity purchased from Iran. According to published reports, about $10 billion, which is held in trust in Iraqi government accounts, will be paid to Iran under this exemption. The decision to extend this exemption and allow the conversion of Iraqi dinars to euros for delivery to Iran was signed one day after U.S. Central Command (CENTCOM) attacked facilities used by the Islamic Revolutionary Guard Corps and other Iranian proxy groups in eastern Syria.
