The International Court of Justice Rejects South Africa's Request Against Israel

The International Court of Justice in The Hague rejected South Africa's request on Friday, February 16, for urgent measures to protect Rafah and prevent Israeli military operations in this part of the Gaza Strip. The judges emphasized that Israel must respect the previous ruling issued by the court late last month. On February 6, the International Court of Justice refrained from issuing a ceasefire order in Gaza while instructing Israel to prevent 'genocide' against Palestinians and to make greater efforts to assist civilians. In its ruling on February 16, the court stated that the 'dangerous situation' in Rafah is applicable throughout the Gaza Strip and does not require additional measures, and that Israel must fulfill its obligations to ensure the security of Palestinians in the Gaza Strip. South Africa submitted a complaint to the International Court of Justice last December, requesting that the judges issue an emergency order to immediately halt military operations in Gaza and accuse Israel of genocide, a request that was rejected by the judges. Recently, South Africa again complained to the International Court of Justice, seeking a legal ruling to prevent Israeli military operations in Rafah. South Africa's complaint elicited a strong and harsh reaction from Israeli officials. Israeli Prime Minister Benjamin Netanyahu accused South Africa of hypocrisy, stating, 'Today we witness an inverted world. Israel is accused of genocide while fighting against genocide.' The Israeli Foreign Ministry also accused South Africa of playing the role of the legal arm of the terrorist organization Hamas based on 'false and baseless claims.' Israel's military operations began in response to a terrorist attack by Hamas on October 7, during which militants killed about 1,200 people, mostly civilians, and took over 240 hostages to Gaza, including the elderly and children. Hamas is listed as a terrorist organization by the United States, the European Union, the United Kingdom, Canada, Japan, and several other countries. The International Court of Justice did not confirm the accusation of genocide against Israel in Gaza. Families of Israeli hostages have urged the International Criminal Court to issue arrest warrants for Hamas leaders. On International Holocaust Remembrance Day, Biden stated that there is a concerning rise in anti-Semitism worldwide. The International Court of Justice issues a ruling regarding South Africa's complaint against Israel and decides on South Africa's request to stop the war in Gaza.
